But they were not built for professional services work involving confidential client data. And the gap between what they are and what consultants use them for is widening into a structural liability.
When you paste a client's financial projections, strategic planning documents, or commercially sensitive market analysis into a consumer AI interface, several things happen simultaneously. The data leaves your environment. It crosses into infrastructure owned by a third party. That third party has terms of service — terms which, in most consumer and even many business tiers, do not constitute a Data Processing Agreement in the legal sense your client's NDA requires. And in many cases, that data has the potential to inform model training, though the specifics vary by provider and tier.
Your NDA with your client almost certainly covers "confidential information shared with third parties." When you put that information into a consumer AI tool, you have shared it with a third party. Whether you intended to or not, you may have breached your agreement — and your client's trust.
Most consultants know this, at some level. They proceed anyway, partly because the productivity gain is immediate and visible, and partly because the compliance risk feels abstract and distant. It doesn't feel like a breach. It feels like using a tool.
When the abstract becomes concrete
The abstraction dissolves the moment a client's IT director, general counsel, or procurement team asks the right question. Those questions are becoming more common. Enterprise clients — particularly in financial services, legal, healthcare, and any sector with regulatory exposure — are building AI governance frameworks that reach into their supply chains. That means their consultants.
The conversation typically starts benign: "We're updating our supplier AI policy — can you fill in this questionnaire about your AI usage?" The questionnaire asks which tools you use, how you handle client data within those tools, what your data retention policies are, whether you have a DPA with your AI providers, and whether your AI infrastructure is certified to relevant standards.

If your answer is "we use ChatGPT Plus" or "we use Claude.ai," and your client is a regulated financial institution or a FTSE 250 company with a serious legal function, that answer may end the conversation in a direction you don't want.
Enterprise subscriptions don't fully solve it either
The natural response is to upgrade to an enterprise tier — ChatGPT Enterprise, Claude for Enterprise, Microsoft Copilot with appropriate licensing. These do address many of the compliance concerns. Data is not used for training. There is a form of DPA. The infrastructure is more clearly separated.
But enterprise tiers from the AI titans carry their own structural limitation: you are betting on a single provider's models and innovation roadmap. The AI landscape is moving fast enough that the model that leads on performance today may not lead tomorrow.
